Key points
Once the decision to replace the windows is made, many owners assume that getting a contractor's quote and lodging the Buildings Department submission is enough to start work — until the management office says "the frame colour does not meet the estate's rules" and the new windows have to come out again. The catch is that window replacement actually involves two procedures: the minor works submission required by law, and the management consent required by the Deed of Mutual Covenant. This article explains the second.
Two Procedures: Submission and Approval Are Different Things
The minor works submission is a requirement of the Buildings Ordinance. Full aluminium window replacement is Class II minor works, and a registered minor works contractor lodges the commencement and completion documents with the Buildings Department — or, for HOS, public housing and Tenants Purchase Scheme estates, with the Independent Checking Unit; see Minor Works Submission for Aluminium Windows. This procedure governs the safety of the works, not their appearance.
Management consent comes from the Deed of Mutual Covenant and the Building Management Ordinance. The deed is a contract between all the owners, and it commonly provides that no owner may alter the external appearance of the building or interfere with common parts without the prior written consent of the manager or the owners' corporation. Windows sit in the external wall, and their frame colour and style directly affect the building's appearance, so most estates treat window replacement as something that needs consent.
Neither procedure replaces the other: Buildings Department clearance does not mean the owners' corporation has agreed, and the corporation's consent does not mean the submission can be skipped.
Common Restrictions in Deeds and Estate Guidelines
Every estate's rules are different, but these come up most often:
| Restriction | Typical rule | What owners should note |
|---|---|---|
| Frame colour | Match the original or the estate's specified colour code | Ask first if you want black or bronze |
| Style and pane layout | Casement, sliding and top-hung positions and divisions follow the original design | Changing a sliding window to a casement usually needs an application |
| Glass | Uniform tint and reflectivity; some estates ban mirror-reflective glass | Insulating glass is fine, but choose clear or lightly tinted |
| Aluminium section | Some estates specify a minimum section (e.g. 50 series) | Affects the price, so get the specification before quoting |
| Works | Scaffolding and external-wall works need advance notice; working hours are restricted | The contractor has to coordinate with the management office |
| Contractor | A few estates require contractors to register with the estate or hold insurance | Submit the documents before work starts |
Large estates usually have a written "window replacement guideline" or "approved window specification" — just ask the management office. In older buildings without guidelines, read the deed itself, looking for clauses on "appearance", "external walls" and "alterations".
The Application: 4 Steps Before Work Starts
On choosing a style, the Aluminium Window Types Guide covers the pros and cons of each, so you can read it first and then ask the management office which styles are permitted.
What Happens If You Replace Windows Without Consent?
By comparison, one written enquiry and a two-week wait cost very little.
A Typical Situation: A Kwun Tong Owner Wants Matt Black Frames
An owner of a private flat in Kwun Tong was renovating the whole flat in a dark interior style and wanted to change the window frames from silver to matt black. The contractor suggested asking the management office first. The office replied that the estate had no written guideline, but the deed required a uniform appearance, so the owner should submit an application for the owners' corporation to consider. The owner attached the contractor's specification and a sketch, pointing out that the wall faced the internal garden rather than the street. The corporation approved it at its next meeting on condition that the glass stayed clear. The works were completed to that specification, and the whole project complied with Class II minor works submission. Frequently Asked Questions
I am the owner and it is my flat's window. Why do I have to ask the corporation?
The window is within your flat, but it also forms part of the building's external appearance. The deed is a contract signed by all owners that restricts each owner from altering the appearance, to protect the value and orderly management of the whole building.
Do I need an application to replace only hinges, handles or glass?
Generally no. These are maintenance and do not change the appearance. But if a glass replacement switches to reflective or tinted glass, some estates treat that as an alteration to the appearance, so it is worth asking.
My tenement building has no owners' corporation or management office. What then?
In a building without a corporation the deed still applies; there is simply nobody enforcing it. Keep as close as possible to the original appearance when replacing windows and retain the submission documents, so that other owners cannot object later.
Do HOS owners also need to ask the management office?
Yes. HOS courts have deeds too, and the submission documents go to the Independent Checking Unit — see the HOS Window Replacement ICU Guide.
In Short: Check the Deed, Then Choose the Style
Ask the management office first, obtain written consent, then quote and submit to the specification, and the process never has to double back. Amgen Windows, licence number MWC 316/2021, carries out window replacement in private buildings, HOS courts and public housing, knows the specification requirements of different estates, and can help prepare the specifications and drawings for an application.
